Australian Property Marketing Pty Ltd ("APM", "we", "us", "our") is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what personal information we collect, how we use it, and your rights in relation to that information.

1. Who this policy applies to

This policy applies to all individuals who interact with APM, including:

  • Agency principals and staff who create an APM account
  • Visitors to our marketing website at australianpropertymarketing.com.au
  • Contacts who enquire via email or other channels

2. Information we collect

We collect personal information that is reasonably necessary for our business functions:

Account information

  • Name and email address (via Clerk authentication)
  • Agency name and business details
  • Billing contact details

Portal credentials

When you connect real estate portal accounts, we store your portal usernames and passwords. All portal credentials are encrypted at rest using AES-256-GCM encryption. We access these credentials only to perform listing syndication on your behalf.

Listing and property data

  • Property addresses and details you enter into APM
  • Photos and media files you upload
  • REAXML data generated from your listings

Usage data

  • Log data (IP addresses, browser type, pages visited)
  • Feature usage patterns (for product improvement)
  • Error and performance data

3. How we use your information

We use personal information to:

  • Provide the APM platform and syndicate your listings to real estate portals
  • Manage your account and subscription
  • Send transactional emails (account notifications, sync status alerts)
  • Respond to your support enquiries
  • Improve our platform and develop new features
  • Comply with legal obligations

We do not sell your personal information to third parties. We do not use your listing data or property information for any purpose other than operating the APM service on your behalf.

4. Third-party services

APM uses the following third-party services to operate our platform. Each has its own privacy practices:

Clerk (Authentication)

We use Clerk (clerk.com) to manage user accounts, sign-in, and organisation management. Clerk processes your name, email address, and authentication data. See Clerk's privacy policy at clerk.com/privacy.

Cloudflare (Media storage & delivery)

Property photos and media files are stored on Cloudflare R2. Cloudflare also provides CDN and DNS services for our platform. See cloudflare.com/privacypolicy.

Railway (Infrastructure)

Our API and database run on Railway infrastructure. Property and account data is stored in a PostgreSQL database hosted on Railway's platform. See railway.app/legal/privacy.

Upstash (Queue processing)

We use Upstash Redis for background job queuing (portal syndication jobs). Queue payloads may contain listing identifiers and job metadata. See upstash.com/privacy.

Vercel (Website hosting)

Our marketing website and dashboard applications are hosted on Vercel. Vercel collects standard web log data. See vercel.com/legal/privacy-policy.

5. Data storage and security

Your data is stored on servers located in Australia or Singapore (Railway infrastructure). We implement industry-standard security measures including:

  • AES-256-GCM encryption for all portal credentials at rest
  • TLS 1.2+ encryption for all data in transit
  • Role-based access controls within the platform
  • Regular security reviews

No method of transmission over the internet or electronic storage is 100% secure. We take commercially reasonable steps to protect your information.

6. Data retention

We retain your account information and listing data for as long as your account is active. If you cancel your subscription, we retain your data for 90 days to allow for account reactivation, after which it is deleted. Backup data may be retained for up to 12 months.

7. Your rights

Under the Australian Privacy Principles, you have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate personal information
  • Make a complaint about how we handle your personal information
  • Request deletion of your account and associated data

8. Cookies

Our marketing website uses minimal cookies — primarily authentication session cookies managed by Clerk, and analytics cookies if you have consented. You can configure your browser to decline cookies; note that some platform features require session cookies to function.

9. Children's privacy

APM is a business platform intended for use by adults in the real estate industry. We do not knowingly collect personal information from individuals under 18 years of age.

10. Changes to this policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or via a notice in the APM dashboard. Continued use of APM after changes take effect constitutes acceptance of the updated policy.
